Welcome to Phoneville Mobile Inc. Website! These Terms and Conditions ("Terms") govern your use of our website and the purchase of our products, which we reserve our right to amend these at any time. By accessing our website or purchasing our products, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using our Website or buying our products.

SECTION 1 - Definitions

Unless the context indicates otherwise, the following terms are defined as follows:

(a) Company – refers to Phoneville Mobile Inc., which is an authorized retailer/distributor of cellular phones in the Philippines;

(b) Customer – refers to any individual who uses or purchases any Product available on this Website;

(c) Order – refers to a Product selected for purchase by the Customer and communicated to the Seller through the form provided by the Website;

(d) Product – refers to any cellular phones sold on the Website;

(e) Sale Contract – refers to the agreement for the sale of a Product between the Customer and the Seller;

(f) Services – refers to the information and services provided in the Website;

(g) Terms and Conditions of Sale – refers to the terms and conditions stated in the Sale Contract for the sale of a Product between the Customer and the Company.

(h) Terms and Conditions of Use of Services – refers to the terms and conditions governing access to the Website or use of the Services, also referred to as "Terms of Use."

(i) Website – refers to the internet platform operated by the Seller at www.phoneville.com.ph, where Products and Services are offered for sale to Customers.

SECTION 2 - Use of Website

  1. Eligibility: You must be at least eighteen (18) years old to use our website and purchase products. By using our Website, you represent and warrant that you are eligible.

  2. Account Registration: To purchase products, the Customer may need to create an account. He or she is responsible for maintaining the confidentiality of his  or her account information and password and for all activities that occur under your account.

  3. Prohibited Activities: The Customer agrees not to use or solicit others to use the website for any unlawful or prohibited activities, including but not limited to:

  • Transmitting any malicious or harmful software;

  • Engaging in fraudulent or deceptive activities;

  • Interfering with the website's functionality or security;

  • Violating any international or local laws or any rules and regulations; or,

  • Infringing intellectual property rights.

SECTION 3 - Orders and Payments

  1. Order Acceptance: All orders placed through the Company’s Website are subject to its acceptance. Phoneville Mobile Inc. reserves the right to refuse or cancel any order for any reason at any given time.

  2. Pricing: All prices are listed in Philippine Peso (₱) and are subject to change without notice. The Website lists the final prices of each product. In case of pricing errors, Phoneville Mobile Inc. shall  not be responsible. However, the Customer shall be notified and allows the Customer to either proceed with the order at the correct price or cancel the order.

  3. Payment Methods: We accept various payment methods, including credit cards, debit cards, and [other payment methods]. By providing the Customer’s payment information, he or she authorizes the Company to charge the amount due to the provided payment method.

  4. Shipping and Delivery: Shipping costs and delivery times vary depending on the shipping method and destination. The Company is not responsible for delays or damages caused by the shipping courier or any force majeure.

Subject to the applicability of any existing law, rule and regulation, the occurrence of a national or local government mandated selective or temporary stoppage of business operations by reason of epidemic, pandemic, or public health emergency shall not in any way hold the Company liable for any delay.

In case the temporary stoppage of business operations lasted for at least thirty (30) cumulative days, the  Buyer may discuss to the Company reasonable options such as, but not limited to, cancellation or replacement of order.

Upon receipt of the delivery, it is the Customer’s duty to verify the accuracy and completeness of the order. Carefully examine the package for any damage or defect. Should the Customer find any defect. Please promptly report it to our customer service for further assistance.


SECTION 4 – Third-Party Links

The website may include materials from third parties and links provided may direct you to third-party websites that are not affiliated to the Company. Thus, the Company shall not be responsible for examining or evaluating the content or accuracy of these third-party materials and websites. The Company does not warrant or assumes any liability or responsibility. It shall be free from any harm or damages  related to the sale or use of goods, services, resources, content, or any other transactions made through third-party websites. Any complaints, claims, concerns, or queries regarding any third-party products shall be directed to the concerned third party.


SECTION 5 - Returns and Refunds

  1. Return Policy: Should the Customer wishes to return the product, the Customer shall inform the Company within five (5) working days  from its receipt.

  2. Refunds: Refunds will be processed within seven (7) working days from the receipt of the returned product. The refund will be issued to the original payment method. Shipping costs are non-refundable.

  3. Conditions for Returns and Refunds: Products must be returned in their original condition, unused, with all original packaging and accessories, and its original sales invoice. The Company reserves the right to refuse returns that do not meet these conditions.

SECTION 5 - Warranty and Liability

  1. Product Warranty: The products come with a [duration] warranty against defects in materials and workmanship. This warranty, however, does not cover damage caused by misuse, neglect, accidents, or unauthorized modifications. The Customer understands that the product is sold “as is”and hereby assumes all risks associated with any defects in the product, whether known or unknown.

  2. Limitation of Liability: The Company’s liability, as well as its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors, are only limited to the purchase price of the product. They shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the products bought.

In case of any claim, the Customer shall indemnify, defend, and hold Phoneville Mobile Inc. free and harmless from any damage or liability to any person arising out of or as a consequence of the sale and use of the Products.


SECTION 6 - Privacy and Data Protection

  1. Privacy Policy: The Customer’s use of the Company’s website is also governed by its Privacy Policy, please click this link: __________________. which is incorporated into these Terms and Conditions by reference.

  2. Data Protection: The Company is committed to protecting the Customer’s personal data in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173). Please review the Privacy Policy for more information on how the Company collects, uses, and protects the Customer’s information.

SECTION 7 - Changes to Terms and Conditions

The Company retain the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the website. The Customer’s continued use of the website and services after any changes constitutes his or her acceptance of the revised terms.

SECTION 8 – Termination

The obligations and liabilities of the Parties incurred before the termination shall continue to be enforceable even thereafter. These Terms remain in effect until terminated by either Parties. The Customer can terminate these at any time by informing the Company that he/she no longer wish to use the services or by stopping to use the Company’s website. If the Company suspects or finds that the Customer has failed to comply with any of the Terms, the Company may terminate this agreement at any time without notice and also deny access to our services.

SECTION 9 – Entire Agreement

This Terms and Conditions constitutes the complete and exclusive agreement of the Customer and the Company with respect to the subject matter referred to herein. This supersedes all agreements, practices, and understanding, oral and /or written, previously entered into by the Parties.

SECTION 10 - Separability

If any term or provision of this Terms and Conditions is declared invalid, void or unenforceable by a court of competent jurisdiction by reason of any applicable law, the remainder shall not be affected thereby and shall continue to remain valid and in full force and effect between the Parties.

SECTION 11 - Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from or relating to these terms shall be resolved in any courts of Metro Manila, Philippines.
